Terms & Conditions

1. Scope

These Terms & Conditions apply to all bookings and participation in events organized by Farbrausch, an experience offered by Rauszeit GmbH.

By booking an event, participants agree to these Terms & Conditions.

2. Booking and Contract Formation

Bookings can be made through the online booking system, by email, or via any other booking method offered by Farbrausch.

The contract is concluded once Farbrausch confirms the booking.

3. Services Included

The scope of services is determined by the description of the booked event.

The price includes the services specified for the respective event, in particular:

• Participation in the Painting Adventure
• Use of all provided painting materials
• Use of the venue and facilities
• Drinks, where included in the selected experience

Any services not expressly listed are not included.

4. Participation

Participation is at the participant’s own risk.

Participants agree to follow all instructions given by Farbrausch staff and to treat the venue, equipment, and materials with care.

Farbrausch reserves the right to exclude participants from an event in cases of seriously disruptive behaviour, excessive alcohol consumption, or if they endanger other participants.

In such cases, no refund will be provided.

5. Clothing and Personal Belongings

Painting materials are used during the events.

Although protective equipment is provided, Farbrausch cannot accept liability for stains or damage to clothing, shoes, mobile phones, or other personal belongings.

Participants are strongly advised to wear suitable clothing.

6. Prices and Payment

The prices displayed at the time of booking apply.

Payment must be made using the payment methods offered during the booking process or as otherwise agreed.

Farbrausch reserves the right to cancel bookings if payment is not received.

7. Cancellation by Participants

Bookings may be cancelled free of charge up to 72 hours before the scheduled event.

Cancellations made between 72 and 24 hours before the event will incur a cancellation fee of 50% of the event price.

No refund will be issued for cancellations made less than 24 hours before the event or in the event of a no-show.

Participants may nominate a replacement participant at any time free of charge.

8. Cancellation or Changes by Farbrausch

Farbrausch reserves the right to cancel, postpone, or exceptionally modify events for important reasons.

In such cases, any payments already made will either be refunded in full or transferred to a replacement date at the participant’s request.

No further claims may be made.

9. Artwork

Participants may take their artwork home after the event.

Upon request, artwork can be stored by Farbrausch for later collection.

Artwork not collected will be stored for a maximum of four weeks after the event date.

After this period, Farbrausch reserves the right to dispose of any uncollected artwork without further notice.

There is no entitlement to storage beyond this period.

10. Photography and Video Recording

Photos and videos may be taken during the events.

Any publication or use of such material for marketing or communication purposes will only take place with the express consent of the persons concerned.

11. Liability

Farbrausch is liable only for damage caused intentionally or through gross negligence.

To the extent permitted by law, liability for slight negligence is excluded.

Liability for lost profits, consequential damages, or indirect damages is excluded.

12. Corporate Events and Group Bookings

Separate agreements and cancellation policies may apply to individually arranged corporate events, team events, or exclusive group bookings.

Such agreements take precedence over these Terms & Conditions.

13. Data Protection

The current Privacy Policy of Rauszeit GmbH applies.

14. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of Austria, excluding its conflict of law provisions.

For business customers, the competent court in Vienna shall have exclusive jurisdiction.

For consumers, the applicable mandatory statutory jurisdiction rules shall apply.

15. Severability

Should any provision of these Terms & Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

Any invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
